1. What these terms cover
These terms apply to the free tools provided by Korn Advisory & Consultancy Pte Ltd (trading as Korn Consultancy), including:
- the APAC Readiness Self-Assessment and any results, summaries or emails it generates;
- our ROI and TCO calculators (including the Retail IoT Technology ROI & TCO Calculator), including those hosted on kornconsultancy.com subdomains;
- our downloadable guides and checklists (including the APAC Market Entry Readiness Checklist); and
- any observations shared in a complimentary Executive Strategy Session that relate to your results;
(together, the "Tools"). They apply in addition to our Terms of Use and Privacy Policy. By ticking the acceptance box or using a Tool, you agree to these terms.
2. Nature of the Tools
- Results are automated, indicative estimates based solely on the information and assumptions you enter, and on general assumptions built into each Tool.
- They are not an audit, a forecast, a valuation, a guarantee of savings, revenue or return on investment, or legal, tax, financial, investment or other professional advice.
- They do not take account of your specific circumstances, and they may contain errors or simplifications.
3. Your responsibilities
You are responsible for:
- the accuracy and completeness of the information you enter;
- verifying results independently, including with your own advisers, vendors and partners, before relying on them; and
- your own decisions. You use the Tools at your own risk.
Please do not enter confidential, commercially sensitive or personal information beyond what a Tool asks for.
4. No reliance and no duty of care
To the maximum extent permitted by law, no one may rely on the Tools or their results, and we owe no duty of care in respect of them. Sharing results within your organisation does not give anyone else a right to rely on them.
5. How we use Tool data
- Assessment: your answers and optional context are stored anonymously so we can show your results and improve the Tool. If you ask for an emailed copy, we also collect your name, work email and company to send it, as described in our Privacy Policy. Marketing emails require separate consent.
- Calculators: the calculators do not collect or store names, emails or company details, and do not set cookies.
- Research: we may use anonymised, aggregated answers (for example average readiness by journey stage) in our research and insights. We will never identify you or your company without your written permission.
6. Intellectual property and permitted use
The Tools, including their questions, logic, calculations, frameworks and design, belong to Korn Advisory & Consultancy Pte Ltd. You may use them and their results for your organisation's internal business purposes, and share our checklist in its complete, unaltered form with attribution. You may not copy, reproduce, reverse-engineer, scrape, resell or build competing tools from them.
7. Availability and changes
We may change, update or withdraw any Tool, its questions, assumptions or scoring, at any time without notice. Results produced at different times may not be comparable.
8. Limitation of liability
To the maximum extent permitted by law, Korn Advisory & Consultancy Pte Ltd (trading as Korn Consultancy), its directors and representatives are not liable for any loss or damage arising from or in connection with the use of, or reliance on, the Tools or their results, including any loss of profit, revenue, savings, business or opportunity, or any indirect or consequential loss. Nothing in these terms excludes liability that cannot be excluded by law.
9. Governing law
These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction.
